What a Shopify ADA lawsuit actually costs: settlement, legal fees, remediation
A single-plaintiff ADA case against a Shopify store has three costs: the settlement, most often $5,000 to $20,000 according to TestParty; the attorney, $3,000 to $5,000 for a demand letter response and $10,000 to $15,000 for a defense through settlement; and the remediation, which depends on the theme and is the only one that is an asset.
The figures below come from two industry sources that track these cases, TestParty's review of 2025 and 2026 lawsuit data and AccessibilityChecker's Shopify accessibility guide, and are written here in summary. Cost one: the settlement
The demand letter opens with a number. TestParty puts the initial demand between $1,500 and $5,000 for most letters; AccessibilityChecker says letters often open around $5,000. The final settlement is usually higher than the opening demand of a letter and lower than the opening demand of a filed complaint, because the firm's costs go up once it files.

AccessibilityChecker reports a similar picture: settlements typically between $5,000 and $75,000 before legal fees. The ranges are wide because the number depends on the state, the firm, how many failures the tester found, and above all on what the merchant puts in front of the firm during the response window. TestParty cites a store that received a $74,999 demand and settled for $2,000, and another whose case was dismissed with no payment at all.
Cost two: the attorney
TestParty reports that responding to a demand letter costs $3,000 to $5,000 in attorney fees, that a full lawsuit defense through settlement costs $10,000 to $15,000, and that taking a case to trial, which almost never happens, costs $50,000 to $200,000 or more. Two things follow from those numbers. First, an experienced ADA defense attorney costs less than a generalist, because the response is a known process for them. Second, the fees grow with time: the sooner the response is backed by an audit and a plan, the fewer hours the negotiation takes.
Cost three: the remediation
Remediation is the work of fixing the theme: audit, changes in Liquid, HTML, CSS and JavaScript, retesting with a screen reader and a keyboard, and the evidence package for your attorney. There is no industry range for it because it depends on four things:
- The theme: a recent theme built on Dawn starts closer to the target than an older or heavily customized one
- The number of templates in play: home, collection, product, cart, search, account, contact, pages, blog
- The apps installed, since each one injects markup that has to be checked and often corrected
- How much of the store is custom sections and third-party scripts
Unlike the other two costs, remediation stays. A remediated theme with a published accessibility statement and a dated record is what makes the next letter unlikely and fast to answer, and it is usually part of the settlement terms anyway. Most settlements include a remediation commitment within 60 to 90 days, so the question is rarely whether to pay for remediation, but whether it is done before the negotiation, where it lowers the settlement, or after, where it does not.
The cost of doing nothing
- A default judgment. A complaint that is not answered by the court's deadline can end in a judgment for the plaintiff, with damages and the plaintiff's attorney fees added. This is the one outcome that costs more than any settlement in the table above.
- A second lawsuit. Firms re-test. According to Appify Commerce's summary of 2025 filings, 1,427 of that year's lawsuits went after companies that had already been sued once. Paying without fixing the store leaves the same failures for the next plaintiff.
- Lost sales. The failures in the letter are real barriers for customers who use a screen reader or a keyboard, and they were there before the letter arrived.
Since 2019, TestParty estimates, the industry has paid about $370 million in settlements and damages. Almost all of it went to cases that could have been answered with a fixed store.
What lowers each number
- Settlement: an audit and a remediation plan with dates inside the response window, then proof the failures named in the letter are gone. Firms respond to evidence.
- Legal fees: an attorney who handles ADA website cases, engaged on the day the letter arrives, with the technical documents ready for the response.
- Remediation: a scoped audit first, fixes in the theme code rather than a widget, and a record that closes the case instead of one that reopens it.

Frequently asked questions
Is the settlement the biggest cost?
For a single-plaintiff case against a small store, usually not on its own. The settlement, the attorney's fees and the remediation are each in the low thousands to low tens of thousands of dollars, and the settlement and the fees go up together when the case is not answered with a plan. The biggest cost is doing nothing, because a default judgment and a second lawsuit both cost more than all three combined.
Can I negotiate the demand down?
Your attorney can, and often does. TestParty cites a store that received a $74,999 demand and settled for $2,000, and another whose case was dismissed with no payment. What moves the number is evidence: an audit, a remediation plan with dates, and proof that the failures named in the letter are gone.
Does remediation replace the settlement?
No. The plaintiff is asking for a payment for the alleged past violation, and remediation addresses the future. What remediation does is lower the settlement position, remove the basis for a follow-up lawsuit, and satisfy the remediation commitment that most settlements include anyway.
What does remediation cost?

Will insurance cover any of this?
Sometimes. Some general liability and cyber policies respond to ADA website claims and some exclude them. Ask your broker on the day the letter arrives, because notice deadlines in policies are short.
